Haryana government reaches SC against HC stay on 75% quota in private sector jobs

The Khattar government of the state has taken refuge in the Supreme Court in the matter of 75 percent quota in private sector jobs for the residents of Haryana. The Haryana government has challenged the decision of the Punjab and Haryana High Court in SC. The High Court has stayed the reservation. The Haryana government has said in the petition filed in the Supreme Court that the High Court issued this decision in a hearing of just one minute and 30 seconds. During this, the counsel for the state was not heard. This decision is also against natural justice. The High Court's decision is not sustainable and should be set aside.

In the matter, the Haryana government demanded an early hearing from the Supreme Court. Solicitor General Tushar Mehta told CJI NV Ramana, the High Court, after listening to me only 90 seconds, gave the verdict and stayed the law. The order has not come yet. We will put up a copy of the verdict. The matter should be heard on Monday. On this, the CJI said that if the copy of the verdict comes, he will hear on Monday.

Significantly, the HC on Thursday, giving a setback to the Haryana government, has stayed the decision of 75 percent reservation for the residents of the state in private sector jobs. This order of Haryana was challenged by the Faridabad Industry Association while filing a petition in the High Court and demanded the High Court to cancel it. Hearing the petition, the High Court stayed this order of the government and ordered the government to respond on it.

The Haryana State Employment Local Candidates Act, 2020 came into force in January this year. This act was applicable to such jobs, in which the maximum salary or salary of the month is up to Rs 30,000. Last year, the Khattar government had said that the Act would be applicable to private sector companies, societies, trusts, limited liability partnership firms, partnership firms and any person who employs more than 10 people on such salary for manufacturing, running business or any other business in Haryana. Will also hire him to give another service. State Deputy Chief Minister Dushyant Chautala had said that this law will create new employment opportunities for thousands of youth.
